These Terms of Service (“Terms”) govern your use of mobile games (“Games”) published by Swiftmade OÜ, registry code 14173141, Pärnu mnt 148, 11317 Tallinn, Estonia (“Swiftmade,” “we,” “us,” or “our”). By downloading, installing, or using any of our Games, you agree to be bound by these Terms.
By accessing or using our Games, you confirm that you are at least 16 years of age and that you agree to these Terms. If you do not agree, you must not use our Games.
If you are between 16 and 18 years of age, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use our Games for your personal, non-commercial use on devices you own or control, subject to these Terms and the applicable app store terms.

Our Games may offer in-app purchases (“IAPs”) that allow you to buy virtual items or other content. All IAPs are processed by the platform provider (Apple App Store or Google Play Store) through which you downloaded the Game.

All content in our Games, including but not limited to graphics, artwork, text, audio, video, software, and game mechanics, is owned by or licensed to Swiftmade and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited license in Section 2.
To the maximum extent permitted by applicable law, our Games are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that our Games will be uninterrupted, error-free, or free of harmful components.
Nothing in these Terms excludes or limits any warranty or consumer right that cannot be excluded or limited under applicable EU or Estonian law.
To the maximum extent permitted by applicable law:
Nothing in these Terms limits our liability for (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded under applicable law.
We may suspend or terminate your access to our Games at any time if you breach these Terms, with notice where practicable. You may stop using our Games at any time by uninstalling them from your device.
Upon termination, your license to use our Games ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will remain in effect.
We may update these Terms from time to time. If we make material changes, we will provide notice through our Games or website. Your continued use of our Games after such notice constitutes acceptance of the updated Terms. If you do not agree, you should stop using our Games.
These Terms are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.
If you are a consumer in the EU, you also benefit from any mandatory provisions of the consumer protection law of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law.
Any disputes arising from these Terms shall be submitted to the courts of Tallinn, Estonia, unless mandatory consumer protection law provides otherwise. EU consumers may also use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
